By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by these Terms of Service (“Terms”). If you do not agree to all the Terms, please do not access or use the Service.

1. AGE REQUIREMENT

You confirm that you are at least 18 years old or the age of majority in your jurisdiction.

2. ONLINE STORE TERMS

You may not use our products for any illegal purpose nor violate any applicable laws. Transmission of malware is prohibited. A breach of the Terms results in immediate termination of Service.

3. GENERAL CONDITIONS

We reserve the right to refuse Service to anyone for any reason at any time. Content (excluding card data) may travel unencrypted over networks; card data is always encrypted.

4. ACCURACY, COMPLETENESS & TIMELINESS

Material on this site is provided for general information and should not be relied upon as the sole basis for decisions. We may modify site contents at any time.

5. PRICES & CURRENCY

All prices are shown in United States dollars (USD). Prices exclude import duties, taxes and brokerage fees levied by the destination country unless expressly stated otherwise. Such charges are the buyer’s responsibility.

6. PRODUCTS & DIGITAL CONTENT

Certain products or services may be available only online and in limited quantities.

Digital content (video master‑classes). The download/stream link is delivered immediately after payment. By starting the download/stream you expressly consent to immediate performance and acknowledge that you lose the 14‑day EU withdrawal right for digital content.

7. PAYMENT METHODS

We accept Visa, Mastercard, American Express, Apple Pay and PayPal. You agree to provide current, complete and accurate billing information and to update it promptly.

8. ORDER PROCESSING & DELIVERY

Processing time: 5 – 7 business days.
Standard delivery: USA 14 – 21 days; Europe 7 – 14 days.
Expedited delivery: USA 7 – 14 days; Europe 5 – 10 days. We do not ship to Australia. Delivery times are estimates; delays caused by customs or carriers are beyond our control.

9. RETURNS, REFUNDS & EU RIGHT OF WITHDRAWAL

Physical goods: Unused items may be returned within 14 days of delivery. Email support@magicgardens.shop with your order number to obtain return authorisation. Ship the product to the address above. Refunds are issued to the original payment method within 14 days of receipt of the return. Shipping costs are non‑refundable unless the item is defective.

Damaged in transit: Please inspect your order upon delivery. If the parcel is visibly damaged you must refuse delivery or request the courier to record the damage. If hidden damage is discovered later, you must file a Damage Report with your local postal operator on the same day of receipt, attach photos of the damaged item and its packaging, and e‑mail the report together with the photos to support@magicgardens.shop. Without a valid Damage Report and photographic evidence we cannot issue a refund or arrange a free replacement. See full details in our [Shipping & Returns Policy].

EU right of withdrawal: Consumers resident in the European Union may cancel the purchase of physical goods within 14 days after receipt without giving any reason. You must bear the direct cost of returning the goods.

10. OPTIONAL TOOLS & THIRD‑PARTY LINKS

Access to third‑party tools or links is provided “as is” without warranties. We have no liability arising from your use of optional tools or third‑party sites.

11. USER CONTENT & COMMENTS

By submitting comments you grant us a worldwide, royalty‑free licence to use, publish and translate them without restriction. Comments must not violate the rights of others or contain unlawful content.

12. PERSONAL INFORMATION

Submission of personal information is governed by our Privacy Policy.

13. ERRORS, INACCURACIES & OMISSIONS

We may correct errors or cancel orders if any information is inaccurate at any time without prior notice.

14. PROHIBITED USES

You may not use the site or its content for unlawful purposes, to infringe intellectual‑property rights, to harass others, to upload malware, to collect personal data, to spam, or to interfere with security features.

15. DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY

The Service and all products are provided “as is” without warranties of any kind. To the fullest extent permitted by law, Magic Gardens shall not be liable for indirect or consequential damages. Where liability cannot be excluded, it is limited to the amount you paid us.

16. INDEMNIFICATION

You agree to indemnify and hold Magic Gardens harmless from any claim arising from your breach of these Terms or violation of any law.

17. SEVERABILITY

If any provision is held unenforceable, the remaining provisions remain in effect.

18. TERMINATION

We may terminate Service without notice if you fail to comply with the Terms. Obligations incurred prior to termination survive termination.

19. GOVERNING LAW & DISPUTE RESOLUTION

These Terms are governed by the laws of Ukraine. Mandatory EU consumer‑protection rules apply to EU residents. Disputes shall be resolved by the competent courts of Ukraine or, for EU consumers, by their local courts.

20. FORCE MAJEURE

We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, labour disputes, embargoes, pandemics, natural disasters or interruptions in internet or utility services.

21. ENTIRE AGREEMENT

These Terms and any policies posted on this site constitute the entire agreement between you and us and supersede prior agreements.

22. CHANGES TO TERMS

We may update these Terms at any time by posting the revised version here. Continued use of the site after changes constitutes acceptance.
